  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The collection of this connection data is strictly necessary to enable you to visit the website, to ensure the long-term functionality, the technically error-free presentation and the optimisation of the website as well as the security of our systems, and to administer our website in general.

Contact form

If you contact us via the contact form or by email, telephone or fax, your enquiry, including the contact details you provide there (name, email, telephone and/or fax number; optional: company), will be stored by us for the purpose of processing your enquiry and in case of follow-up questions. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR where your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), where this has been requested; consent can be withdrawn at any time.

The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to its storage or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Online appointment / demo requests

On our website, you have the option of testing our services and requesting a demo. To do so, you can arrange an appointment with us directly.

We use the tool ‘Calendly’ to book appointments. The provider is Calendly LLC, 271 17th St NW, 10th Floor, Atlanta, Georgia 30363, USA (hereinafter ‘Calendly’).

To book an appointment, you enter the requested data (email address, name, additional message if applicable) and your preferred appointment (date and time) in the form provided. The data entered is used for planning, conducting and, where applicable, following up on the appointment. The appointment data is stored for us on the servers of Calendly, whose privacy policy you can view here: https://calendly.com/de/pages/privacy.

The data you enter remains with us until you ask us to delete it, withdraw your consent to its storage or the purpose for storing the data no longer applies. Mandatory statutory provisions – in particular retention periods – remain unaffected.

The legal basis for the data processing is Art. 6(1)(b) GDPR, as the data processing is necessary in the context of initiating or performing a contract.

Where Calendly uses tools that require consent, Calendly requests this consent in accordance with Section 25(1) of the German Telecommunications and Telemedia Data Protection Act (TTDSG).

We have concluded a data processing agreement with the provider. The data transfer to the USA is based on the standard contractual clauses of the European Commission. You can find details here: https://calendly.com/pages/dpa.

Email marketing

If you would like to receive the newsletter or the email marketing campaigns offered on the website, we need an email address from you as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the email marketing campaigns or newsletter. No further data is collected, or only on a voluntary basis. To manage the email marketing campaigns and the newsletter, we use newsletter service providers, which are described below.

This website uses BREVO to send email marketing campaigns and newsletters. The provider is BREVO, c/o Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany.

BREVO is a service that can be used, among other things, to organise and analyse the sending of email campaigns and newsletters. The analysis can determine whether the message was opened, which links were clicked and whether, for example, a purchase was made after the message was clicked. The data you enter for the purpose of receiving emails or the newsletter is stored on the servers of BREVO in Germany.

BREVO also enables us to divide recipients into different categories (‘clustering’). As part of this categorisation, recipients are divided according to their country of origin. In this way, the mailings and newsletters can be better tailored to the respective target groups.

If you do not want analysis by BREVO, you must unsubscribe from our mailings. For this purpose, we provide a corresponding link in every message.

You can find detailed information on the functions of BREVO at the following link: https://www.brevo.com/de/legal/privacypolicy/.

The data is processed on the basis of your consent (Art. 6(1)(a) GDPR). You can withdraw this consent at any time. The lawfulness of the data processing operations that have already taken place remains unaffected by the withdrawal.

The data you have provided to us for the purpose of receiving mailings is stored by us or by the newsletter service provider until you are removed from the recipient list, and is deleted from the distribution list once you have unsubscribed from the mailings. Data stored by us for other purposes remains unaffected.

After you have been removed from the distribution list, your email address may be stored in a blacklist by us or by the newsletter service provider, where this is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and is not merged with other data. This serves both your interest and our interest in complying with the statutory requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). We store the data for as long as our legitimate interest in keeping the data in the blacklist persists.

For further details, please refer to the privacy policy of BREVO at https://www.brevo.com/de/legal/privacypolicy/.

eCommerce

On our website, you have the option of placing an order via the web application ‘Shopify’. The provider is Shopify International Limited, Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (hereinafter ‘Shopify’).

To place an order, you enter the requested data (name, email, address; optional: company) in the form provided. The data entered is used to process your order and to contact you. Your personal customer and contract data is stored for us on the servers of Shopify, whose privacy policy you can view here: https://www.shopify.de/legal/datenschutz.

The data collected is processed by us and used as customer and contract data to establish, shape the content of and amend our contractual relationships. The legal basis for this is Art. 6(1)(b) GDPR.

We have concluded a data processing agreement with the service provider. The data transfer to the USA is based on the standard contractual clauses of the European Commission. You can find details here: https://www.shopify.com/legal.

The customer data collected is deleted after the order has been completed or the business relationship has ended and any statutory retention periods that may apply have expired. Statutory retention periods remain unaffected.

On our website, you have the option of downloading a free e-booklet in which we present some of our case studies to you. For this, we need your contact details (name and email; optional: telephone and company).

The legal basis for the data processing is our legitimate interest within the meaning of Art. 6(1)(f) GDPR in providing you with a booklet when you request one. We store the data required for the e-booklet order for a maximum of two years.

Landau Media uses the Microsoft Dynamics service to process user data. You can find information on data processing at: https://privacy.microsoft.com/de-de/privacystatement.

4. Integration of third-party services

On some pages of this online offering, third-party content (such as videos from YouTube, external map material, RSS feeds, graphics, etc.) from other websites is embedded. This always requires that the providers of this content (hereinafter referred to as ‘third-party providers’) can see your IP address. Without the IP address, the third-party providers would not be able to send the content to your browser.

The IP address is therefore necessary for the display of this content. We endeavour to use only content whose providers use the IP address solely to deliver the content. However, we have no influence over any further use of your data (e.g. if the third-party providers store the IP address for statistical purposes).

5. Analytics services

Landau Media uses various Google services for analytical purposes. Use of the websites is evaluated exclusively in anonymised form in order to compile reports on website activity for the website operators and to provide further services connected with website and internet use, as well as to improve the web offering.

The data collected is stored on servers of Landau Media GmbH & Co. KG and is under no circumstances passed on to third parties.

6. Cookies

Our websites use so-called ‘cookies’. Cookies are small text files and do not cause any damage to your end device. They are stored on your end device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are deleted automatically at the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or your web browser deletes them automatically.

In some cases, cookies from third-party companies may also be stored on your end device when you visit our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for processing payment services).

Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g. the display of videos). Other cookies are used to analyse user behaviour or to display advertising.

We use tools that are necessary for the operation of the website on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR, in order to provide the basic functions of our website. In certain cases, these tools may also be necessary for the performance of a contract or for the implementation of pre-contractual measures; the processing is then carried out pursuant to Art. 6(1)(b) GDPR. Access to and storage of information in the end device is strictly necessary in these cases and is based on the laws implementing the ePrivacy Directive in the EU member states and, in Switzerland, on Section 25(2) TTDSG.

We use all other, non-essential (optional) tools that provide additional functions on the basis of your consent pursuant to Art. 6(1)(a) GDPR. Access to and storage of information in the end device then takes place on the basis of the laws implementing the ePrivacy Directive in the EU member states and, in Switzerland, on Section 25(1) TTDSG. Data is processed using these tools only if we have obtained your consent for this in advance.

Where personal data is transferred to third countries (such as the USA), we refer you, also with regard to the risks that may be associated with this, to section 6 (‘Data transfers to third countries’). We will inform you if an adequacy decision exists for the third country concerned or if standard contractual clauses or other safeguards have been concluded for the use of certain tools. If you have given your consent to the use of certain tools and to the associated transfer of your personal data to third countries, we transfer the data processed when using the tools to third countries (also) on the basis of this consent pursuant to Art. 49(1)(a) GDPR.

Consent with Borlabs Cookie

Our website uses the consent technology of Borlabs Cookie to obtain your consent to the storage of certain cookies in your browser or to the use of certain technologies, and to document this in compliance with data protection law. The provider of this technology is Borlabs GmbH, Rübenkamp 32, 22305 Hamburg (hereinafter Borlabs).

When you visit our website, a Borlabs cookie is stored in your browser, in which the consents you have given or the withdrawal of these consents are stored. This data is not passed on to the provider of Borlabs.

The data collected is stored until you ask us to delete it or delete the Borlabs cookie yourself, or until the purpose for storing the data no longer applies. Mandatory statutory retention periods remain unaffected. You can find details on the data processing by Borlabs Cookie at https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/.

The Borlabs Cookie consent technology is used to obtain the consents required by law for the use of cookies. The legal basis for this is Art. 6(1)(f) GDPR.

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that allows us to integrate tracking or statistics tools and other technologies into our website. Google Tag Manager itself does not create user profiles, does not store cookies and does not carry out any independent analyses. It merely serves to manage and deliver the tools integrated through it. For this purpose, Google Tag Manager uses JavaScript and generally works without the use of cookies.

Google Tag Manager is used on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the quick and uncomplicated integration and management of various tools on its website.

We have concluded a data processing agreement with Google Ireland Limited. In the event that personal data is transferred by Google Ireland Limited to the USA or other third countries, Google Ireland Limited and Google LLC have concluded standard contractual clauses (Implementing Decision (EU) 2021/914, Module 3) pursuant to Art. 46(2)(c) GDPR.

You can find further information in Google’s information on Tag Manager: https://support.google.com/tagmanager/answer/6102821.

Our website uses the Google Analytics 4 service (‘Google Analytics’), which is offered by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland for individuals in Europe, the Middle East and Africa (EMEA) and by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA for all other individuals (together ‘Google’).

This serves to analyse your usage behaviour and to improve our website. We will process the information obtained in order to evaluate your use of the website and to compile reports on website activity for the website operators. The data arising in this context may be transferred by Google to a server in the USA for evaluation and stored there.

As part of the evaluation, Google Analytics 4 also uses artificial intelligence, such as machine learning, for the automated analysis and enrichment of the data. This is done in particular for predictive metrics on the future behaviour of visitors based on structured event data, such as predicted revenue, purchase probability and churn probability. The predictive metrics can also be used for predictive audiences. You can find out more at: https://support.google.com/analytics/answer/9846734.

In addition, Google Analytics 4 models conversions where there is not enough data available, in order to optimise the evaluation and reports. You can find information on this at: https://support.google.com/analytics/answer/10710245.

The data is evaluated automatically with the help of artificial intelligence or on the basis of specific, individually defined criteria. You can find out more at: https://support.google.com/analytics/answer/9443595.

We have made the following data protection settings in Google Analytics 4:

  • IP anonymisation (truncation of the IP address before evaluation);
  • Automatic deletion of old visit logs by limiting the retention period to 14 months;
  • Resetting of the retention period upon new activity;
  • Collection of precise location, position and device data;

    Technical information: operating system;
  • Browser type, version and language; device type, brand, model and resolution;
  • Approximate location (country and, where applicable, city, based on anonymised IP address).

You can find further information on the cookies of Google Analytics 4 at: https://support.google.com/analytics/answer/11397207?hl=de.

Google AdSense

Our website uses the Google AdSense service, which is offered by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland for individuals in Europe, the Middle East and Africa (EMEA) and by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (‘Google’) for all other individuals.

Google AdSense enables the placement of advertising on third-party sites and is based on an algorithm that selects the advertisements displayed on third-party sites to match the content of the respective third-party site. This allows visitors to be addressed on the basis of their interests (targeting), which is implemented by generating individual usage profiles. When you visit our website, your use is analysed and evaluated for this purpose. Each time a subpage is accessed, data is automatically transmitted to Google for the purposes of online advertising, generating advertising revenue and settling commissions. In the process, Google obtains knowledge of personal data, such as your IP address, which Google uses, among other things, to trace the origin of visitors and clicks on advertisements. Google also processes the data to improve and further develop its own products and services, to improve the delivery of advertising on third-party sites, for reporting, and to prevent and combat fraud and abuse. For this purpose, Google AdSense uses in particular cookies, which are stored on your end device, and pixels, which establish a connection to the Google server. The data arising in this context may be transferred by Google to a server in the USA for evaluation and stored there.

Google AdSense may set and read the following cookie on your end device:

  • ‘_gcl_au’ (90 days): Conversion tracking, storage of ad clicks.

The legal basis for this data processing is your consent pursuant to Art. 6(1)(a) GDPR. Access to and storage of information in the end device then takes place on the basis of the laws implementing the ePrivacy Directive in the EU member states and, in Switzerland, on Section 25(1) TTDSG. Your data is transferred to the USA and other third countries on the basis of your explicit consent pursuant to Art. 49(1)(a) GDPR.

If you use a Google account, Google may, depending on the settings stored in the Google account, link your web and app browsing history to your Google account and use information from your Google account to personalise ads. If you do not want this association with your Google account, you must log out of Google before accessing our website.

If you have not consented to the use of Google AdSense, Google will only display general advertising that has not been selected on the basis of the information collected about you on this website. In addition to withdrawing your consent, you also have the option of deactivating personalised advertising in the advertising settings at Google: https://adssettings.google.com/notarget.

You can find further information in the notices on data use: https://policies.google.com/technologies/ads; in Google’s privacy policy: https://policies.google.com/privacy.

Google Ads Remarketing and Google Ads conversion tracking

Our websites use the ‘Google Ads’ service, which is offered by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland for individuals in the European Economic Area and Switzerland and by Google LLC 1600 Amphitheatre Parkway Mountain View, CA 94043, USA for all other individuals (together ‘Google’).

With Google Ads, customer actions defined by us (such as clicking on an advertisement, page views, downloads) are recorded and analysed by means of ‘Google Ads conversion tracking’. We use ‘Google Ads Remarketing’ to show you personalised advertising messages for our products on Google partner websites. Both services use cookies, JavaScript, pixels and other technologies for this purpose. Google also processes the data to improve and further develop its own products and services, for the aggregated statistical evaluation of conversions and to improve the quality and accuracy of conversions. The data arising in this context may be transferred by Google to a server in the USA for evaluation and stored there.

The following cookies are set and read by Google:

  • ‘_gcl_au’ (90 days): Conversion tracking, storage of ad clicks;
  • ‘_gcl_aw’ (90 days): Conversion tracking, storage of ad clicks;
  • ‘_gac_UA-123360018-1’: Addition of the Google click identifier in the URL for conversion tracking (auto-tagging).

If you have not consented to the use of Google Ads, Google will only display general advertising that has not been selected on the basis of the information collected about you on this website. In addition to withdrawing your consent, you also have the option of deactivating personalised advertising in the advertising settings at Google: https://adssettings.google.com/notarget.

7. Social media

We maintain online presences on social networks in order to communicate there with customers and prospects, among other things, and to provide information about our services. The data of users is generally processed by the social networks concerned for market research and advertising purposes. This allows usage profiles to be created based on the interests of users. For this purpose, cookies and other identifiers are stored on the end devices of the data subjects.

In the course of operating our online presences, we may be able to access information such as statistics on the use of our online presences, which are provided by the social networks. These statistics are aggregated and may include, in particular, demographic information (e.g. age, gender, region, country) as well as data on interaction with our online presences (e.g. likes, subscriptions, sharing, viewing of images and videos) and the posts and content distributed through them. They can also provide information about the interests of users and which content and topics are particularly relevant to them. We may also use this information to adapt the design of our online presence and our activities and content on it, and to optimise them for our audience. You can find details and links to the data of the social networks to which we have access as operators of the online presences in the list below.

The legal basis for the data processing is Art. 6(1)(f) GDPR, based on our legitimate interest in effective information and communication with users, or Art. 6(1)(b) GDPR, in order to stay in contact with our customers and keep them informed, and to implement pre-contractual measures with prospects.

For the legal basis of the data processing carried out by the social networks under their own responsibility, please refer to the privacy notices of the respective social network. At the links below, you will also find further information on the respective data processing and on the options for objecting.

Please note that data protection requests can be asserted most efficiently with the respective provider of the social network, as only these providers have access to the data and can take appropriate measures directly. Of course, you can also contact us with your request. In this case, we will process your request and forward it to the provider of the social network.

In the members’ area of our website, we use the pop-up window tool Wisepops from Wisepops, SAS 87 Boulevard Suchet 75016, Paris, France. We use the pop-up windows for advertising purposes, for example to send you information about new functionalities or adjustments to our products or to inform you about new products from Landau Media. In order to show you suitable pop-up windows, the following information about your website visit is processed in particular:

  • Your last visit to the website;
  • Your browsing behaviour on our website;
  • Your interactions with the pop-up windows (such as views, clicks, sign-ups).

This enables us, for example, to recognise whether you are visiting our website for the first time or have already seen a pop-up. This information is stored only on your end device and is not kept on the servers of Wisepops. In addition, the information is not shared with other services, and activities on other websites are neither tracked nor linked to it.

In addition to the data stored on your end device, the following data is processed and transmitted when a connection is established to the servers of Wisepops, in order to display the content of the pop-up window:

  • Your IP address;
  • Technical information about your browser, your operating system and your end device (HTTP header, user agent).

The legal basis for the processing operations described is Art. 6(1)(f) GDPR, our legitimate interest in serving pop-up windows. By storing your website usage data solely on your end device, we have taken measures to reduce the data processing to the necessary extent. The storage and reading of the information in cookies is therefore also strictly necessary pursuant to Section 25(2) no. 2 TTDSG.

Cookies are set to provide the Wisepops service. You can find further information on the cookies set at: https://support.wisepops.com/article/u39zrabrl2-datenschutz-und-cookie-richtlinie. The storage period of the cookies is a maximum of 2 years.

We have concluded a data processing agreement with Wisepops. You can find details here: https://wisepops.com/data-processing-agreement. Wisepops in some cases uses service providers that are based in third countries, i.e. countries outside the European Economic Area (EEA). In this case, Wisepops has concluded appropriate safeguards, such as standard contractual clauses, with these service providers. You can find out more about the transfer of data to third countries and the risks that may be associated with it in the sub-section ‘Disclosure of data to third parties and third-party providers’.

You can find further information on the tool and on the data processing at: https://support.wisepops.com/article/u39zrabrl2-datenschutz-und-cookie-richtlinie.

9. Webinars / online events

To conduct webinars, video calls and online events, we use the services of GoTo Technologies Ireland Unlimited Company, which is based in Dublin, Ireland, as well as Microsoft Teams.

You can find further information and the privacy policy of GoTo and Microsoft Teams at: https://www.goto.com/de/company/legal/privacy/international or at https://privacy.microsoft.com/de/de/privacystatement.

10. Events

If you register for events offered by Landau Media, we collect your title, name, address, email address and, where applicable, company. For events subject to a fee, your payment details are added. Your data is processed at your request and is necessary under Art. 6(1), first sentence, point (b) GDPR to hold the event (and, where applicable, for invoicing). Once the stated purpose has been fulfilled, your data is deleted, unless retention of the data is necessary to pursue legitimate interests of Landau Media GmbH & Co. KG or on the basis of a statutory provision (e.g. law, statutory ordinance).

11. Newsletter

If you have expressly consented to receiving emails pursuant to Art. 6(1), first sentence, point (a) GDPR, we use your email address to send you newsletters regularly. For this purpose, we collect your name, your email address and, where applicable, your company affiliation and your areas of interest.

You can unsubscribe at any time by withdrawing your consent.

After you unsubscribe, your data is deleted, unless retention of the data is necessary to pursue legitimate interests, such as the processing of payments, or on the basis of a statutory provision (e.g. law, statutory ordinance).

12. Applicant data

The data of applicants is collected and processed for the proper conduct of the application process and until its conclusion, in accordance with the principle of selection by merit, and for the establishment of an employment relationship that may follow. The data is processed on the basis of the General Data Protection Regulation (GDPR).

After collection, the application data is stored for as long as is necessary for the respective task, taking into account the applicable retention periods, including, where applicable, documentation obligations. As a rule, the submitted/provided data is deleted after six months at the latest if no employment relationship follows.

Landau Media offers the application process by email, by post or via an online application form.

The personal data associated with an application (name, telephone number, address, email, application documents, notes taken during job interviews, etc.) is collected insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is Art. 6(1)(b) (initiation of a contract) and Art. 88(1) GDPR in conjunction with Section 26(1), first sentence, of the German Federal Data Protection Act (BDSG). Where consent has been given for applicant data to also be used to make contact about future job offers – Art. 6(1)(a) GDPR. Consent can be withdrawn at any time.

Recipients of personal data (Art. 4(9) GDPR) in the application process: employees in the HR department of Landau Media GmbH & Co. KG and senior staff.

If the application is successful, the submitted data is stored in our data processing systems on the basis of Section 26 BDSG and Art. 6(1)(b) GDPR for the purpose of carrying out the employment relationship.

If no job offer can be made, or a job offer is declined or withdrawn, Landau Media reserves the right to retain the submitted data on the basis of legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data is then deleted and the physical application documents are destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g. due to an imminent or pending legal dispute), deletion takes place only once the purpose for the further retention no longer applies.

Longer retention may also take place if the applicant has given corresponding consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent deletion.

Landau Media GmbH & Co. KG uses the onlyfy one (by XING) service to process applications. You can find information on data processing in the privacy policy.

13. Security measures

We implement organisational, contractual and technical security measures in line with the state of the art to ensure that the provisions of the data protection laws are complied with and thereby to protect the data processed by us against accidental or intentional manipulation, loss, destruction or access by unauthorised persons.

14. Data recipients and transfers to third countries

Disclosure of data

The data we collect is disclosed only if there is a legal basis under data protection law for doing so in the specific case, in particular if:

  • You have given your explicit consent to this pursuant to Art. 6(1)(a) GDPR,
  • the disclosure is necessary pursuant to Art. 6(1)(f) GDPR to establish, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in your data not being disclosed,
  • we are legally obliged to disclose the data pursuant to Art. 6(1)(c) GDPR, in particular where this is necessary due to requests from authorities, court orders and legal proceedings for legal prosecution or enforcement, or
  • this is permitted by law and is necessary pursuant to Art. 6(1)(b) GDPR for the performance of contractual relationships with you or for the implementation of pre-contractual measures taken at your request.

Part of the data processing may be carried out by our service providers. In addition to the service providers mentioned in this privacy policy, these may include, in particular, data centres that store our website and databases, software providers, IT service providers that maintain our systems, agencies, market research companies, group companies and consulting firms. Where we pass data on to our service providers, they may use the data exclusively to perform their tasks. We have selected and commissioned the service providers with care. They are contractually bound by our instructions, have appropriate technical and organisational measures in place to protect the rights of the data subjects, and are monitored by us on a regular basis.

Data transfers to third countries

As explained in this privacy policy, we use services whose providers are in some cases located in so-called third countries (outside the European Union or the European Economic Area) or process personal data there, i.e. countries whose level of data protection does not correspond to that of the European Union. Where this is the case and the European Commission has not issued an adequacy decision (Art. 45 GDPR) for these countries, we have taken appropriate precautions to ensure an adequate level of data protection for any data transfers.

These include, among others, the standard contractual clauses of the European Union or binding corporate rules.

Where this is not possible, we base the data transfer on the derogations under Art. 49 GDPR, in particular your explicit consent or the necessity of the transfer for the performance of a contract or for the implementation of pre-contractual measures.

Where a transfer to a third country is envisaged and there is no adequacy decision or appropriate safeguards, it is possible, and there is a risk, that authorities in the third country concerned (e.g. intelligence services) may gain access to the transferred data in order to collect and analyse it, and that the enforceability of your data subject rights cannot be guaranteed. You will also be informed of this when we obtain your consent via the consent banner.

Hosting

We host our website with RAIDBOXES. The provider is RAIDBOXES GmbH, Hafenstr. 32, 48151 Münster, Germany (hereinafter RAIDBOXES). When you visit our website, RAIDBOXES collects various log files, including your IP address. You can find details in the privacy policy of RAIDBOXES: https://raidboxes.io/datenschutzerklaerung/.

RAIDBOXES is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website as reliably as possible.

We have concluded a data processing agreement (DPA) with the provider named above. This is a contract required under data protection law, which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

15. Credit checks

In the event of a credit risk, we transmit your data (name, address, email address, company details and, where applicable, contract and receivables data) for the purpose of a credit check, to verify the deliverability of the address provided and for debt collection purposes to IHD Gesellschaft für Kredit und Forderungsmanagement mbH, Augustinusstr. 11 B, 50226 Frechen, and Creditsafe Deutschland GmbH, Schreiberhauer Straße 30, 10317 Berlin, Germany.

The legal basis for this transmission is Art. 6(1)(f) GDPR; our legitimate interest is to check, where there is a justified suspicion, whether there is a risk of financial default.

You can find further information on data protection at: https://www.ihd.de/datenschutz#informationen_art14_wirtschaftsinformation or https://www.creditsafe.com/de/de/rechtliches/datenschutzhinweise/datenschutzhinweise-fuer–auskunfteidaten.html.

16. Deletion of data

The data stored by us is deleted as soon as it is no longer required for your intended purpose and there are no statutory retention obligations preventing deletion. Where your data is not deleted because it is required for other, legally permissible purposes, its processing is restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.

In accordance with statutory requirements, data is retained for 6 years pursuant to Section 257(1) of the German Commercial Code (HGB) (commercial books, inventories, opening balance sheets, annual financial statements, commercial letters, accounting vouchers, etc.) and for 10 years pursuant to Section 147(1) of the German Fiscal Code (AO) (books, records, management reports, accounting vouchers, commercial and business letters, documents relevant for taxation, etc.).

17. Rights of the user

Where the respective statutory requirements are met, you are entitled at any time to the data subject rights set out in Art. 7(3), Arts. 15–21 and Art. 77 GDPR:

  • Right to withdraw your consent (Art. 7(3) GDPR);
  • Right to object to the processing of your personal data (Art. 21 GDPR);
  • Right of access to your personal data processed by us (Art. 15 GDPR);
  • Right to rectification of your personal data stored incorrectly by us (Art. 16 GDPR);
  • Right to erasure of your personal data (Art. 17 GDPR);
  • Right to restriction of the processing of your personal data (Art. 18 GDPR);
  • Right to the portability of your personal data (Art. 20 GDPR);
  • Right to lodge a complaint with a supervisory authority (Art. 77 GDPR).

To exercise the rights described here, you can contact us at any time using the contact details given above. This also applies if you would like to receive copies of safeguards as evidence of an adequate level of data protection. Where the respective legal requirements are met, we will comply with your data protection request.

You have the right to withdraw any consent you have once given at any time by notifying us. As a result, we will no longer continue the data processing that was based on this consent in the future. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the withdrawal.

Where we process your data on the basis of legitimate interests, you have the right to object to the processing of your data at any time on grounds relating to your particular situation. Where the objection is to data processing for direct marketing purposes, you have a general right to object, which we will implement without you having to give reasons.

If you wish to exercise your right to withdraw consent or to object, an informal notification to the contact details given above is sufficient.

You have the right to lodge a complaint with a data protection supervisory authority. You can exercise this right, for example, with a supervisory authority in the member state of your place of residence, your place of work or the place of the alleged infringement. For private-sector data protection in the Canton of Zurich, the Federal Data Protection and Information Commissioner (FDPIC) is responsible.

18. Validity of and changes to the privacy policy

This privacy policy is currently valid in the version dated 20 July 2023.

Landau Media reserves the right to amend this privacy policy in order to take account of changes in applicable laws and regulations.

However, this applies only with regard to statements on data processing. Where consent is required or parts of the privacy policy affect provisions of the contractual relationship, changes will be made only with consent.
